Terms and Conditions (Terms of Service)

1. Scope and Parties

These Terms and Conditions govern the subscription and use of the LeadHook24 platform between Steffen Schirmer ("Provider") and the business client ("Client"). Services are provided strictly for commercial entities (B2B).

By accepting these Terms, the Client agrees to the Data Processing Agreement (DPA) available here, which the Client may review beforehand, pursuant to Art. 28 GDPR. The DPA becomes part of this contract upon formation of the usage agreement.

2. Scope of Services

LeadHook24 provides cloud software designed to capture, qualify, classify, and instantly respond to inbound customer leads on behalf of real estate and service businesses.

The monthly scope of services depends on the subscribed plan:

"AI operating hours" means the business hours configured by the Client in the dashboard. Inquiries received outside these hours are translated manually, within the applicable monthly quota.

3. Subscriptions and Activation

The contract becomes effective upon completion of the checkout process and delivery of account credentials.

4. Pricing and Payment

All prices are in Euros, exclusive of applicable Spanish Value Added Tax (IVA 21%). Fees are billed in advance on a recurring monthly or annual basis.

5. Term and Cancellation

The contract may be terminated for convenience by either the Client or the Provider:

Termination must be declared in text form, e.g. by email to info@leadhook24.com. The right to extraordinary termination for good cause remains unaffected.

6. Usage Scope and Fair Use Policy (Enterprise Plan)

The provision of unlimited AI replies within the Enterprise plan is subject to a Fair Use Policy for standard commercial operations. Typical fair business usage is defined as up to 5,000 leads per billing month. In the event of persistent excessive volume, disproportionate infrastructure load, or indications of automated misuse (such as bots, scraping, or mass querying), the Provider reserves the right to contact the Client, arrange a custom high-volume enterprise agreement, or terminate the subscription with a 14-day notice period. In cases of severe abuse, the Provider reserves the right to temporarily suspend access immediately.

7. System Availability

The Provider aims for a 99% annual average uptime (excluding scheduled maintenance). This figure is a target, not a guaranteed minimum availability or a warranted quality characteristic.

8. Limitation of Liability

Automated (AI-generated) responses and translations constitute suggestions or automated communication. No warranty is given as to their factual or legal accuracy; the Client is advised to review them.

Liability is limited to foreseeable damages and capped at the total amount paid by the Client in the preceding 12 months.

9. Governing Law and Jurisdiction

These Terms are governed by Spanish law. Exclusive place of jurisdiction shall be Málaga, Spain.
